General

Images on Picture Arabia are classified in one of the following categories: Rights Managed (RM),and Royalty Free (RF).

RM images are licensed on a use by use basis. The cost for a particular image is based on the size, duration, placement and geographical area of usage. When licensing an image this specific information will be requested and will form an integral part of the licensing agreement.

RF images may be used numerous times for various projects without incurring additional/ongoing charges. The only restriction is that the images are only for the use of the company licensing the image (or the agency if purchasing on behalf of a client), and may not be passed onto a third party for their own usage.

For print purposes images will be supplied at 300dpi as JPG files (TIFF files can be arranged upon request). Images for website usage will be supplied at 100dpi.

RM images will be sized according to the intended end usage (eg. 1/8th page in A4 brochure).

All images are copyrighted and may not be reproduced in any format whatsoever without the prior written consent (ie. contract)/completion of a licensing agreement) and appropriate payment to Picture Arabia.

All images on the Picture Arabia website are taken in Middle East, Gulf states, and/or muslim countries/cultures in other parts of the world. Images are intended to represent Arabic cultures positively and realistically, and images may not be used negatively or to portray individuals or the culture in a derogatory way. Images may not be manipulated in this respect.

If any images cause offence or annoyance in any way the concerned party should contact Picture Arabia and the issue will be investigated and may result in specific images being withdrawn from the site.

Images of foreigners and expatriates are all taken within the region and/or in muslim countries. Images that appear generic or international were all taken in the Middle East, the Gulf states, and/or in other arabic/muslim countries. Images portray expatriates living and working in the region, as well as Arabic peoples.

Picture Arabia reserves the right to decline usage of any image at any time, without reason. Images that appear on Picture Arabia do not necessarily guarantee their availability, as the image(s) may be under license to other parties at the time of inquiry. The availability of any image will be confirmed upon receipt of an inquiry/request for quotation.

Select images on Picture Arabia (those images marked with an * or denoted by "display only") are not for sale and are included solely to display purposes, showing arabic culture, traditions, and lifestyle, as well as displaying the work of contributing photographers. It may be possible to shoot very similar new images and PA can supply photographers for this purpose upon request. The copyright of such images may belong to third parties and or related clients. These images are examples of similar images available, and also as examples of images that may be commissioned by clients specifically. Perspective clients will be advised of images that are not available upon application. It may be possible to license images that belong to third parties, but only once their permission has been gained.

Terms of Usage

In licensing an image(s) from PA you unequivocably agree to the above conditions and terms of usage. The complete conditions of usage for any specific image(s) will be detailed in a licensing agreement that will be required for completion and signature in all cases (prior to the image(s) being supplied).

Re-usage of the stated image(s) without permission will be regarded as an infringement of copyright, and will be subject to increased usage fees and/or legal proceedings.

All images are licensed on a non-exclusive/non-transferable basis, unless otherwise agreed and stipulated on the licensing agreement.

Images may not be passed to a third party under any circumstances. In doing so the client will be liable for all costs relating to the unauthorised usage of the image. The client also accepts full responsibility in passing the image(s) to subcontractors eg. designers, printing houses etc. and will be liable for all costs in the event the subcontractor misuses the image(s).

Images may not be resold having been originally licensed form Picture Arabia. Images may not be marketed on other sites by clients and/or agencies with the intention of selling the images.

It is understood by the client that there are no model, property, or other releases in relation to the licensed image(s), unless specifically stated in the agreement. If releases exist copies of these documents will be supplied to the client in all cases.

PA, its staff and contributors will not accept any liability whatsoever following the licensing of an image(s) to the client. The client unequivocably agrees to this in signing this agreement.

All payments are required by credit card in advance of the image being supplied, unless credit has been agreed in writing and stipulated in the licensing agreement

The payment terms stated are fixed and an integral part of this image licensing agreement. Failure to comply with these terms will be regarded as a breach of the agreement and will directly affect the client’s right to usage of the image(s).

High resolution files will be made available for downloading following payment, and can be done so by following the emailed link provided by PA. Once payment has been made images are usually immediately available for downloading, however in some cases it may require upto 12 hours for the image(s) to be available for download.

The client is responsible for its employees and their usage of the image. The client will be responsible for employees utilising the image(s) whether in or out of its direct employment.

Under no circumstances does any part of this agreement suggest that the client is purchasing the copyright of the image(s). Neither does the agreement suggest any sort of partnership with PA. The copyright and exclusivity remains with PA and/or its contributor(s).
